By placing an order with Patina Botanicals, you agree to the following terms:

Product Availability
All products are subject to availability. We reserve the right to limit quantities, cancel orders, or issue refunds for unavailable items.

Seasonal & Agricultural Variability
Our products include live plants and seasonal goods. Availability, timing, and plant performance may vary due to environmental and growing conditions.

Product Representation
Photos and descriptions are representative only. Actual plants may vary in size, fullness, color, and growth habit.

Pricing & Errors
We reserve the right to correct pricing, listing, or inventory errors and cancel or adjust orders accordingly.

Transfer of Responsibility
All responsibility for live plants transfers to the customer upon pickup.

Limitation of Liability
To the fullest extent permitted by law, Patina Botanicals is not liable for any indirect, incidental, or consequential damages. Liability is limited to the purchase price of the item.

Right to Refuse Service
We reserve the right to refuse service, cancel orders, or limit quantities at our discretion.

LIVE PLANT POLICY

Patina Botanicals sells live vegetable, herb, and specialty plants. These are living, variable products—not uniform manufactured goods.

By purchasing, you acknowledge:

Plant size, shape, fullness, and appearance will vary
Growth, yield, and fruit production are not guaranteed
Fruit size, flavor, heat level, and productivity vary by growing conditions
Minor cosmetic imperfections may occur and are normal
Photos are for reference only

We do not guarantee:

Plant survival after pickup
Fruit production or yield
Specific plant size or maturity
Performance under any specific growing conditions

Once plants leave our care, all risk transfers to the customer.

RETURN & REFUND POLICY

Due to the perishable nature of live plants:

All sales are final

We do not accept:

Returns
Exchanges
Cancellations

Refunds are ONLY issued if:

An item is sold out or unavailable AND cannot be fulfilled

Refunds will be limited to the purchase price of that item only.

No refunds will be given for:

Improper care or growing conditions
Missed pickup
Weather damage (frost, heat, wind, etc.)
Transplant shock
Pest or disease issues
Failure to thrive or produce

Pickup Policy

Local pickup is available in:

Manhattan, IL
Oak Forest, IL (limited availability)

Pickup Terms:

Your selected pickup date is a request only
Final pickup details will be confirmed 5–7 days prior
Exact address and instructions will be provided at that time
Please do NOT arrive without confirmation

Pickup Options:

Scheduled weekend pickup events
Limited appointment-based pickups

Missed Pickup Policy:

Orders not picked up during the confirmed window may be forfeited without refund due to the perishable nature of live plants.

Rescheduling is not guaranteed and is at our discretion.

We reserve the right to adjust pickup timing due to:

Weather
Crop readiness
Inventory availability
Operational needs

SOLD-OUT / SUBSTITUTION POLICY

If an item becomes unavailable:

You will be contacted (if time allows), OR
A refund will be issued for that item

We do NOT substitute products without your approval.

NO WARRANTY DISCLAIMER

All products are sold “as is” without warranties of any kind, expressed or implied, including but not limited to merchantability or fitness for a particular purpose.

CHARGEBACK & DISPUTE POLICY

By placing an order, you agree to contact Patina Botanicals first to resolve any issue.

We reserve the right to dispute chargebacks using:

Order records
Policy acceptance at checkout
Communication history
Pickup confirmations

Fraudulent or unjustified chargebacks may be contested to the fullest extent permitted.

PRIVACY POLICY

We collect customer information (name, email, phone, and order details) to:

Process orders
Coordinate pickup
Communicate with customers

We do not sell or share personal information outside of necessary service providers (payment processors, website platform, etc.).
